Terms & Conditions for Aviana At Tuscany Apartments

These Terms & Conditions (“Terms”) govern your use of https://avianareno.com (the “Site”), operated by Aviana At Tuscany Apartments (“Aviana,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms govern only your use of the Site. They are not the lease agreement. The lease agreement between Aviana and any resident is a separate, signed document that controls your tenancy and the obligations of both parties under it.

1. Use of the Site

You may use the Site to learn about our community, view available floor plans, submit inquiries and applications, schedule tours, submit maintenance requests as a resident, and access related information. You agree to use the Site only for lawful purposes and not to:

  • Submit false, misleading, or fraudulent information through any form on the Site;
  • Attempt to gain unauthorized access to any part of the Site, our systems, or any other user’s information;
  • Use any automated means (bots, scrapers, crawlers) to access, copy, or harvest content from the Site without our written permission;
  • Interfere with or disrupt the Site’s operation, security, or the experience of other visitors;
  • Use the Site in a way that violates any applicable law or regulation, including fair-housing laws.

2. Accuracy of Information

We work to keep information on the Site — including floor plan availability, pricing, sizes, amenities, and photos — accurate and current. However, this information may change without notice, and we do not warrant that everything on the Site is free of errors or fully up to date at any given moment.

Pricing, availability, and floor plan details are not offers and do not constitute a binding agreement. Final pricing, availability, lease terms, deposits, and fees are confirmed only through a signed lease agreement. Photos may depict representative units rather than the specific unit you may lease, and amenities listed are subject to change, maintenance, and community rules.

3. Fair Housing

Aviana is an Equal Housing Opportunity provider. We do not discriminate on the basis of race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected under federal, state, or local law.

4. Applications and Tour Requests

When you submit a rental application through the Site, you authorize us to verify the information you provide, including running background, credit, employment, and rental history checks as permitted by law. Submission of an application does not guarantee approval or a leasing offer. Application fees, if any, are disclosed at the time of application and are governed by the application terms you accept when you apply.

Tour requests and contact form submissions are inquiries only and do not reserve units, hold pricing, or create any commitment from either party.

5. Resident Portal and Third-Party Services

Our resident portal (Pay Rent, lease documents, work-order submission) is provided through a third-party property-management platform (RentManager). When you use the portal, your interactions with the platform are governed by that provider’s terms of service and privacy policy in addition to ours. We are not responsible for the availability, content, or practices of any third-party service.

6. Intellectual Property

The Site, including all text, photos, floor plan images, video, graphics, logos, designs, and code, is owned by Aviana or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share Site content for personal, non-commercial purposes. You may not reproduce, modify, distribute, publicly display, or create derivative works from any Site content without our prior written permission, except for fair-use purposes permitted by law.

7. User Submissions

If you submit a review, comment, photo, or other content to us through the Site, by email, or through our social media, you grant Aviana a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with marketing the community. You represent that you own the content you submit and that it does not infringe any third party’s rights.

8. Links to Third-Party Sites

The Site may link to websites and services we do not operate, including the resident portal, social media platforms, map providers, and form services. We provide these links for convenience and are not responsible for the content, accuracy, or privacy practices of any linked site.

9. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Aviana, its owners, affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Site. Our total liability for any claim arising out of these Terms or your use of the Site will not exceed one hundred U.S. dollars ($100). This limitation does not apply to liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Aviana and its owners, affiliates, officers, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

12. Governing Law

These Terms are governed by the laws of the State of NV, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in NV, and you consent to the jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after a change constitutes your acceptance of the updated Terms. If a change is material, we will make reasonable efforts to notify visitors more prominently — for example, with a notice on the Site.

14. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
